Coming Home and Back to the Office

I know you are tired when you get home. You want to throw the suitcase in a corner, put your feet up and relax. Don’t. Your pre-planning must include time for unpacking and data entry. It is a part of travel. Immediately unpack. I unpacked my truck after a three month trip within an hour of coming home. If you don’t do it now, you won’t do it. Put your traveling laundry in a separate location from your regular laundry. You’ve already made the decisions about what to take, so don’t mix everything up and make it harder on yourself the next time. Take what needs to go to the dry cleaners the next day. It is another part of your travel schedule.
Refer to your list as you unpack and make notations on what you needed and cross out things you didn’t use. This helps keep the list a working document. Clean and put the “ready to go” items back in the suitcase.
Traveling will never be completely stress-free, but if you follow these guidelines, you will find yourself cluttering less and being more at ease.

Getting a Good Night’s Sleep

If you don’t sleep well last night or the other night and any night, you’ll have a cluttered mind. There is no way to insure you’ll get a quiet and peaceful room. You can think on one with the reservations clerk, but that seems to work about as often as flipping a coin just to decide. You can make reservations online, but forget it. I am a very light sleeper and here’s what has worked for me. Don’t try to waste your time telling the 800 number reservations clerk. How about try searching on the internet where you can type it into comments online, because it might help to have something in writing. Also you can get the local phone number of the hotel. Try to call and tell the desk clerk what you want. Get his name and tell him that you will personally pay him to put you in a quiet room. Five dollars might do it, but no more than 10. I learned this traveling in Mexico and it works fine here in the U.S., too.
If you can stay with the same chain, you will be more familiar with what you are getting. That means a lot in reducing stress and relaxing for a while. I have found really good deals and pleasant surprises with independent motels, but there have been about as many unpleasant ones. Hilton Hotels one which you can afford them, offer dependable quality and familiarity, as do Holiday Inns. I am more likely to be found in the Red Roof Inns, Comfort Inns, Howard Johnson’s, and Econo Lodges. Despite their name, Econo Lodges generally have large rooms and decent furnishings for less money. Red Roof has rooms with real computer desks! Not all of the locations have them, but they are certainly a plus.
Reservations usually don’t really know what a quiet room is, so you have to be specific and direct to the point. If you are staying in a hotel with a bellman, you are in luck. These guys have actually been to the rooms and, for a fiver, can fix you right up. You want an interior room in a large hotel, not facing the street. A courtyard is ideal. In a motel you want a room on the end, in the back of the parking lot. First floor rooms have less street noise than second floor rooms, but you get the early morning and late evening traffic. Second floor is quieter than third. People think higher is better. It isn’t. Being next to an elevator doesn’t bother me, but some people hate it. Personally, I prefer it, since it is usually shielded from traffic noise and keeps you from having another room on one side.
1 love rooms with Jacuzzi’s, but try not to get a room next to a Jacuzzi suite. Jacuzzi users tend to be night owls. I always make sure my room has a bathtub. A hot bath after a long trip can be a real life-saver. And, if you’re like me, it’s a great place to meditate.
As soon as you arrive in your room, check out the air conditioning! heating. It should be loud enough to mask noise, but quieter than a B-52. it’s easier to change rooms right away than it is later. Pack three clothespins to keep the drapes together. Even in the nicest places (except in Las Vegas), they never seem to completely close. A thin shaft of light can keep you from sleeping.
Even with the best precautions you will get burned sometimes. I checked into a marvelous hotel near Boston one night and it was a big quiet room on a corner and away from the street. A group of college kids took over the floor and had a party. I called the front desk and they did nothing. I called the cops and they threw the kids out. Sometimes you have to take care of yourself. Don’t delay. Those things don’t get better with time.
Today there are white noise machines on small clock radios. They don’t take up that much space and will pay you back the trouble of carrying them and then some. Get one with a battery backup. Do not ever trust the alarm clock in the hotel to be accurate. I’ve seen them set to 9:00 a.m. when it is 9:00 p.m.
Put two or three neon-colored dots, from an office supply store, on your appliances.

The lawyer’s primary consideration

The lawyer’s primary consideration is not so much the theory of liability but the settlement prospects and the defendant’s ability to pay. Some people are at the apex of the litigation hit list.
Businessmen (especially Taipei), rich professionals, media and show biz personalities, property owners, bank officials, officers and directors of publicly traded companies, are some of the most attractive defendants. Lawyers who work on contingency fee know that “good defendants” include banks, mortgage companies, insurance companies, mall owners, and real estate developers because they have the financial ability to pay the judgment. Individuals and small businesses require more investigation before contingency-fee lawyers agree to take the case.
The investigation will include credit history, real estate holdings, chattels, bank accounts, stocks, mutual funds, franchises, jewelry and other investments. Investigators have myriad ways of discovering hidden wealth. If substantial assets are discovered and located, the lawyer and his client will probably make a decision to file a lawsuit against you.

The Hit List: Target Defendants In The Shooting Gallery

Everyone is a potential lawsuit target. But there are people who are more attractive targets, those walking around town with a flashing neon sign that says, “Please hit me, I have the money!” Predators have the habit of including all possible responsible parties in their hit list of potential targets. This pernicious practice multiplies the odds that one of the named defendants could be you, a party against whom a judgment could be enforced.
It is only a matter of time. In this dog-eat-dog world, anyone can be sued for any reason. But some are more inclined to be the target of a lawsuit than others. People engaged in business, landowners and professionals are exposed to lawsuits more than others. Lawyers always worry about collecting the judgment, They look forward to a huge fee once the case is resolved if they are working on a contingency fee arrangement. Many of them wish to separate you from your possessions. There is a large pool of litigation targets. Some people may not be physically attractive but are considered legally attractive to plaintiffs and lawyers who are scouring the earth to pin down a deep pocket defendant or at least set him up for a nifty settlement. Once you have been chosen to be a defendant in a lawsuit, you will be compelled to shell out money to defend yourself. Lawyers are not known to defend people on a contingency fee basis. A substantial acceptance fee and a monthly retainer fee will be required in many cases.

Distinctive Features of Public Speaking

Conversations represent a free-flowing, spontaneous, fluid process of communication. The conversationalist is both a speaker and a listener in an ongoing interaction. The conversation itself is a series of fragments that may or may not fit together well. In contrast, public speaking defines the roles of speaker and listener more clearly. Speeches may seem fresh and spontaneous, but good speeches are the product of carefully considered research, audience analysis, design, wording, and practice. In public speaking, the medium of communication can affect the message, as in the case of speeches presented on radio or television.

Finally, the environment in which communication occurs can change dramatically. Speaker and Listener Roles Are Clearly Defined. In conversation, it is often hard to tell who is the speaker and who is the listener. In public speaking, however, there is seldom doubt as to who the speaker is and who the listeners are. Moreover, public speaking spotlights the role of the speaker. Whether speakers can take advantage of this prominence depends on their ability to reward listeners with interesting and useful messages. As Aristotle pointed out more than two thousand years ago, our impressions of speakers themselves affect how we respond to what they say. We are far more inclined, he observed, to react favorably when we think speakers are competent in their subject matter and when we trust them. These ancient qualities of competence and integrity form the basis of the modern term credibility. Aristotle also noted that audiences respond more favorably when speakers seem likable— when they seem to be people of good will. Modern researchers have uncovered still another important speaker characteristic, forcefulness (or dynamism). 13 Some speakers strike us as vital, action-oriented people. When important interests are at stake and action seems called for, we may turn to such people to lead the way. These qualities of likableness and forcefulness combine to form the basis for another modern term, charisma.’4 Taken together, credibility and charisma provide an updated account of what Aristotle called the ethos of the speaker.’5 We consider ethos at greater length.

In public speaking, the role of the listener is also essential. As we will know, ideal listeners are supportive, yet listen carefully and critically. Such listeners seek the value in all messages and listen actively and enthusiastically, rather than passively and apathetically. Finally, listeners help construct the meaning in messages. Because the fate of a message depends on how listeners respond to it, speakers must always keep their audiences in mind. Indeed,it shows that effective speech preparation begins with audience analysis. What needs or problems concern them? What subjects interest them? What biases could distort their reception of messages? Such questions are crucial to the selection of your topic and to the way you frame your message.
